    AIMS, OBJECTS AND RULES
    (Is amended at a meeting of the All India Committee held at New Delhi on September 9, 1990)
     
    AKHIL BHARAT AKHIL BHARAT HINDU MAHASABHA
    (Register under Act XXI of 1860)
     
    1.NAME
    The name of the Association shall be the AKHIL BHARAT AKHIL BHARAT HINDU MAHASABHA.
    2. JURISDICTION
    The jurisdiction of the Akhil Bharat Hindu Mahasabha shall extend to the whole of India or Bharat, as it existed before August 14, 1947.
    3.AIM
    The aim of the AKHIL BHARAT HINDU MAHASABHA as it to establish a really democratic Hindu State in Bharat, based on the culture and tradition to Hindu Rashtra and to re-establish Akhand Bharat by all constitutional means.
    1.    A)
    “AKHIL BHARAT HINDU MAHASABHA bears faith and allegiance to the constitution of India as established by Law and to the principles of Socialism, Secularism and Democracy and would uphold Sovereignty, Unity and Integrity of India.”
    4. OBJECTS
    The objects of the Akhil Bharat Hindu Mahasabha are:
    1.    To remove all forms of inequalities and disabilities and thus to establish an order in which all nationals will enjoy equal opportunities to serve the State.
    2.    To assure to each national, full freedom of thought, expression, association and worship, not inconsistent with the national interest
    3.    To make Bharat militarily strong and self-reliant in defense.
    4.    To promote the glorious ideals of Aryan womanhood and to establish Ashrams for the protection, education and vocational training of women and children.
    5.    To make Bharat politically, economically, morally and materially strong and self-reliant
    6.    To remove gross inequalities in the distribution of wealth, to assure a decent standard of living to each national and to secure to the workers and peasants their rightful share in economy of the country and to promote class co-ordination instead of class conflict.
    7.    To reclaim all those who have left Hindu fold and welcome others into it.
    8.    To promote protection of cow and its progeny and to ban cow slaughter.
    9.    To establish Sanskritised Hindi as the National Language and Devnagari as the National Script, with due regard to regional languages.
    10.    To cultivate friendly relations with other nations with a view to maintain internal and international peace and progress.
    11.    To ameliorate the economic, social and political conditions of the so called Scheduled Castes and Scheduled Tribes as well as the Backward Classes, so as to bring them on par with other nationals of the country as early as possible.
     
    1.    To carry on Charitable, Social, Educational and Religious activities in accordance
    with programs laid down from time to time by the Working Committee of the Akhil Bharat Hindu Mahasabha and to acquire by purchase, gift, or otherwise , and manage properties, buildings and other assets, and / or dispose them off for the purpose of carrying out the above aims and objects.
     
    1.    To establish culture contacts, and cohesion with the Hindus abroad and to intensity Hindu Missionary work all over the world.
    1.    To incorporate or promote institutions, societies or associations having objects wholly or in part similar to any of the above objects and to lay down from time to time suitable programs with a view to accomplish the above objects.
     
    5.MEMBERSHIP
    (a) PRIMARY MEMBERS
    Any Hindu of 18 years and over who accepts in writing the Aims and Objects of the Akhil Bharat Hindu Mahasabha, is entitled to become a primary member of the Akhil Bharat Hindu Mahasabha on payment of Rs. 10/-biennial{Rupees Ten only} per TWO years.
    A.Hindu means a person who regards this land of Bhartavarsha from the Sindhu to the seas as his fatherland, as well as his Holy land.
    (b) LIFE MEMBERS
    A person who subscribe to the aims and objects of the Akhil Bharat Akhil Bharat Hindu Mahasabha and pays Rs. 200[Rupees TWO HUNDRED only] in lump sum as his subscription to the Akhil Bharat Hindu Mahasabha will be considered as a life member of the Akhil Bharat Hindu Mahasabha subject to the approval of the Working Committee of the Akhil Bharat Hindu Mahasabha.
    Such a life member, shall be entitled to enjoy all rights and privileges and responsibilities that any primary member enjoys in any capacity in the organizations subject to his paying any additional fee of Rs. 25/-biennially for being Active Member prescribed for such a position.
    (c)ACTIVE MEMBERS
    A primary member may be enrolled as an Active member of the Akhil Bharat Hindu Mahasabha if he is of the age 21 or over and has been primary member for consecutive two years and pays an additional biennial subscription of Rs. 25 [Rupees TWENTY FIVE only] and fulfills any two of the following conditions: -
     
    1.    Collects as donation or himself donates Rs.25/- [Rupees TWENTY FIVE only] towards Hindu Mahasabha Fund.
    2.    Enrolls at least 25 primary members biennially.
    3.    Maintain a cow in his house.
    4.    Has produced original literature of approved worth on Hindu ideology.
    5.    Has suffered   imprisonment in the cause of the Akhil Bharat Hindu Mahasabha.
    6.    Works on Shuddhi front.
    7.    Devotes at least 20 hours on an average in a month for Akhil Bharat Hindu Mahasabha work.
    Active membership shall be continuous so long as the biennial subscription is paid and other condition are prescribed are fulfilled. Only Active Members shall be eligible to stand as a candidate for election of Office-Bearers of Akhil Bharat Hindu Mahasabha and its branches.
    The condition of remaining primary member for two years before becoming an active member shall not apply where a new Akhil Bharat Hindu Mahasabha branch is being established.
    6. REGISTERS OF MEMBERS
    Every unit of the Akhil Bharat Hindu Mahasabha shall maintain permanent registers of primary and Active members and shall supply lists of the same to their respective higher units and the State Sabhas shall supply lists of their Active Members to the Akhil Bharat Hindu Mahasabha headquarter and keep it informed of changes therein.
    7. CONSTITUENTS
    The Akhil Bharat Hindu Mahasabha shall include the following Sabhas and Committees:
    1.    Village (Gram) / Ward in a City or Town (Nagar) Hindu Sabhas.
    2.    Constituency (Vidhan Sabha) Hindu Sabhas.
    3.    District (Janpad) or City (Mahanagar) Hindu Sabhas.
    4.    Provincial (Pradesha) Hindu Sabhas.
    5.    The All India Committee (Kendriya Mahasamiti)
    6.    The Working Committee (Kendriya Karya Karini Samiti)
    8.CONSTITUTION OF UNITS
    The various constituent units of the Akhil Bharat Hindu Mahasabha shall be constituted as follows:
    (a)VILLAGE AND TOWN HINDU SABHAS
    Twenty or more person residing in a Village or a Ward can form themselves into a Village or a Ward Hindu sabha. Forty or more persons residing in a town can themselves into a Town Hindu Sabha. There may be different Branch or Ward Sabhas in a town. In towns, where there are Branch or Ward Sabhas, the Town Sabha shall consist of representatives of the Branch or Ward Sabhas.
    There shall not be more than one Hindu Sabha for the same village, ward or town.
    (b) CONSTITUENCY HINDU SABHAS
    Twenty percent representatives of the primary members of the village or Town Hindu Sabhas within a Vidhan Sabha provided there are at least sixty primary members in the Constituency. The number of such representatives to the Constituency Sabha General Council will not exceed thirty-five and the units will given proportionate representation. If, however, there are no village or town Hindu Sabhas in the Constituency, sixty primary members in Constituency can constitute a Constituency Hindu Sabha.
    (c) DISTRICT OR CITY HINDU SABHAS
    Twenty percent representatives of the members of all Constituency Sabhas situated within the jurisdiction of District or City shall constitute the District or City Hindu Sabha General Council does not exceed one hundred and includes members from at least three constituency Hindu Sabhas.The Units will be given proportionate representation.
    (d) PROVINCIAL HINDU SABHAS
    a. In the Akhil Bharat Hindu Mahasabha organization the following shall constitute the provinces: -
    1.    Andhra Pradesh
    2.    Assam including Arunachal, Manipur, Nagaland, Tripura and Meghalaya.
    3.    Bengal including Andaman and Nicobar Islands.
    4.    Bihar
    5.    Chandigarh
    6.    Chhattis Garh
    7.    Delhi
    8.    Gujrat including Daman, Diu, Dadra and Nagar haveli.
    9.    Haryana
    10.    Himachal Pradesh
    11.    Jammu and Kashmir
    12.    Jharkhand
    13.    Kerala including Lacadive, Minicoy and Aminive Islands.
    14.    Madhya Pradesh
    15.    Maharashtra including Goa
    16.    Karnataka
    17.    Punjab
    18.    Pondicherry
    19.    Rajasthan
    20.    Sindh
    21.    Tamil Nadu
    22.    Orissa
    23.    Uttar Pradesh
    24.    Uttranchal
    b. The Working Committee of the Akhil Bharat Hindu Mahasabha shall have power to  alter the boundaries of Pradesh Hindu Sabhas or create new Pradesh Hindu Sabha or create new Pradesh or amalgamate Pradeshes into one Hindu Sabha in consultation with the Pradesh Sabhas concerned.
    ii. RULES REGARDING PROVINCIAL (PRADESH) HINDU SABHAS
    1.    without prejudice to the power and rights of the Akhil Bharat Hindu Mahasabha over the control, management, assets and properties of all the units generally, each units Sabha shall be treated as separate entity for purpose of transactions among themselves and separate accounts shall be maintained by each unit, which should be managed by their respective Working Committee elected according to the rules framed by each Pradesh Sabha for the management of the units under them. A single individual or Office bearers authorized by respective Working Committee shall be competent to represent respective units in all courts of law and other matters. Akhil Bharat Hindu Mahasabha only delegates its power to its different units for convenience of management without prejudice to its own rights including the right of suspension or dissolutions of any of the units as provided for in Rule Thirteen(R. 13)
       b.      Each Pradesh Hindu Sabha shall organize District and other Sabhas and shall have     
          power to frame a Constitution for its organization and to make Rules for the
          conduct of its business which, however should not be inconsistent with the
          Constitution of Akhil Bharat Hindu Mahasabha or any rule or rules framed by the All india committee of     ABHM Such Rule or Constitution framed by the  Pradesh
          Hindu Sabha shall be subject to the approval of the Working Committee of the Akhil Bharat Hindu Mahasabha in absenceof any such constitution the rules laid down in this Constitution shall generally apply to it.
      8d.       Each Pradesh Hindu Sabha shall submit an Annual Report of the work done
    during the year in the State, along with details of their assets with full particulars to the Akhil Bharata Akhil Bharat Hindu Mahasabha generally by the end of February.
     
    1.    No Pradesh Hindu Sabha can expel any member under its jurisdiction from the
    organisation for more than two years without the consent of The Working Committee of the Akhil Bharat Akhil Bharat Hindu Mahasabha, But in case of any member of the Council or Working Committee of the State, expulsion must have prior consent of the Working Committee of the Akhil Bharat Hindu Mahasabha.
    1.    No unit of the Akhil Bharat Hindu Mahasabha shall be responsible for any financial liability of  the other. The Akhil Bharat Hindu Mahasabha and all its Constituent Hindu Sabhas shall be responsible only for their respective liabilities.
    1.    The Akhil Bharat Hindu Mahasabha shall shoulder financial responsibility only regarding its own acts of ommissions and commissions pertaining to the property situated at Mandir Marg, New Delhi and any other property  purchased by them and registered in their name directly in or out of Delhi.
     
    1.     There shall be one Pradesh Hindu Sabhas in each State, which shall consist of representatives of District or City Hindu Sabhas in proportion to their primary membership strength, provided that each District or City will have at least one member on the of Pradesh Hindu Sabha, irrespective of its membership strength. Total number of members of Council of the Pradesh Sabha shall not exceed 250.
    1.     The Pradesh Hindu Sabha shall have power to co-opt not more than 20 members in addition to the number prescribed above.
     
    1.    A Pradesh Hindu Sabha shall have at least one thousand primary members before it is affiliated or its affiliation is renewed by  the Working Committee of the  Akhil Bharat Hindu Mahasabha.
    1.     A certificate signed by the President or General Secretary of the Pradesh Hindu Sabha shall accompany the list of the members of the All India Committee confirming counterfoils of the receipts for 1000 members covering at least two district Hindu Sabhas. The Head Office may call for the counterfoils as and when it deemed necessary.
    e.       ALL INDIA COMMITTEE (KENDRIYA MAHASAMITI) OF THE  AKHIL BHARAT HINDU MAHASABHA
    The All-India Committee of the Hindu Mahasabha shall consist of :
       
    1.    The President, the Working President if any, All ex-Presidents, All ex-Working Presidents, all ex-Vice Presidents who continue to remain primary members of the Hindu Mahasabha, provided, however that these ex-office bearers of the All India Committee shall not be counted in the respective strength of the elected members of All India Committee on behalf of the State Hindu Sabhas concerned
    2.    Office-bearers of the preceding All India Commitee.
    3.    Members elected by every Pradesh Sabha, out of its members in a general meeting, held with agenda for such election by the end of February every tenure ss according to the following scale: -
                      Five members from every Pradesh, Irrespective of membership strength
                      Five members for 1,000 primary members.
                      Ten members for 3,000 primary members.
                      One member for every 500 primary members exceeding 3,000.
                      The maximum for every Pradesh will be fifty members.
    1.    No member belonging to one state (Pradesh) Hindu Sabha would be entitled to be elected or nominated on the All India Committee by any other state (Pradesh) Hindu Sabha unless he or she has residence  and / or vocation and / or has any immovable property in that particular state.
    2.    No member enjoying directly or indirectly any office of profit in the t Akhil Bharat Hindu Mahasabha organisation that is any employee or any one else pay of any organization functioning under the direct control of the  Akhil Bharat Hindu Mahasabha shall be entitled to be elected as a member of the All India Committee. Payment of honorarium by the Akhil Bharat Hindu Mahasabha to any person shall be treated as an exception.
    3.    A list of such members must be supplied to the Akhil Bharat Hindu Mahasabha Office at Hindu Mahasabha Bhawan Mandir Marg, New Delhi by every Pradesh Hindu Sabha by the 15th of March every year along with the affiliation fees payable by it, according to the scale mentioned in Article – 13.
     
    1.    THE WORKING COMMITTEE (KENDRIYA KARYAKAINI SAMITI) OF THE AKHIL BHARAT HINDU MAHASABHA
    The  National Working Committee of the Akhil Bharat Hindu Mahasabha shall consist of :
    i.          The President of the Biennial Session.
    1.    Office bearers of the Akhil Bharat Hindu Mahasabha elected for the coming tenure, by the All India Committee of the Akhil Bharat Hindu Mahasabha at first meeting held immediately after the Biennial Session.
    2.     20 representatives elected out of the members of the All-India Committee of the Akhil Bharat Hindu Mahasabha.
    3.    Five members nominated by the President, out of the members of the Akhil Bharat Hindu Mahasabha who will be deemed to the members of the All-India Committee ex-officio.
    4.    No members would be entitled to be elected or nominated on the Working Committee or as an office bearer of the Akhil Bharat Hindu Mahasabha contrary to Article 24(c) i.e. if he is member of any other political party in Bharat. Membership of non-political or religious organization would be permitted.
    5.    Every member of the Working Committee of the Akhil Bharat Hindu Mahasabha shall pay it to the biennial  fee of Rs. 25/- (Rupees Twenty five only) for executive  membership. Unless the fee is paid, no member shall be entitled to take part in the proceedings of the Working Committee of the Akhil Bharat Hindu Mahasabha.
    9. OFFICE   -   BEARERS
    The Office – bearers of the Akhil Bharat Hindu Mahasabha shall be:
     i. a. One President of the Annual Session ex - officio
        b. One Working President,
        c.  Vice – Presidents, upto SIX
    1.    THREE Secretaries:
    i.  General Secretary
    ii.  Organizing Secretary
    iii.  Office Secretary
    1.    Four Zonal Secretaries
    2.    The Treasurer
     
     ii. The Office – bearers will continue in their office till their successors take over the
         charge.
    1.    The President shall be the Supreme Head of the whole organization. The General Secretary shall be in the charge of the organization, as its Chief Executive, subject to the general control of the President. The Treasurer shall be in charge of the funds of the  Akhil Bharat Mahasabha.
     
    10.FINANCIAL YEAR
    The Financial year of the Hindu Mahasabha shall be reckoned from the 1st April to 31st March.
    11.DIVISION OF MEMBER SHIP FEE
    A. The membership fee of the Akhil Bharat Hindu Mahasabha shall be divided amongst the various Sabhas as under: -  
    40  % to     the Unit.
    15  % to     the immediate higher Unit.
    15  %  to     the District or City Unit.  
    15  %  to     the Pradesh Unit.  
    15  % to     the Akhil Bharat Hindu Mahasabha.
     
    B. Every Member elected to the All-India Committee shall pay to it Biennial fee of Rs.25/-  (Rupees Twenty five) for membership of the All-India Committee. Unless the fee is paid, no member shall be entitled to take part in the proceedings to the All-India Committee or the Subjects Committee of the Biennial Session.
    12. POWERS AND DUTIES OF THE ALL INDIA COMMITTEE
    The powers and duties of the All-India Committee (Kendriya Mahasamiti )of the  Hindu Mahasabha shall be:
    1.    To pass the annual accounts, duly audited and adopted by the Working Committee.
    2.    To lay down general policy and consider resolutions on current problems, which may be placed before it by the Working Committee and / or if a notice thereof is given by any of its members at least 7 days before the meeting
    3.    To pass a report of the activities of the tenure submitted by the General Secretary.
    4.    To fill in casual vacancies amongst its members from recommendations of the Pradesh Sabha of the State from which the member causing the vacancy was elected or in the sbsence of such recommendation from the State, to elect a member by its own resolution.
    5.    To exercise all the powers and duties of the Akhil Bharat Hindu Mahasabha, including amendments to the Constitution.
     
    13. POWERS AND DUTIES OF THE NATIONAL WORKING COMMITTEE
    i. The National working Committee of the Akhil Bharat Hindu Mahasabha shall have powers to:
    1.    Take all steps necessary for working out the Aims and Objects of theAkhil Bharat Hindu
    Mahasabha.
    1.    Consider and Pass resolutions on current topics, recommend resolution on general policy to the All India Committee and implement resolutions passed by the Session and by the All India Committee.
    2.    Collect and invest or borrow fund, acquire, hold sell, mortgage or lease properties, moveable or immoveable and sign necessary documents for and on behalf of the Akhil Bharat Hindu Mahasabhaand for the objects of the Akhil Bharat Hindu Mahasabha .But this right to sell, lease or mortgage or otherwise deal with shall not apply in the case of the Hindu Mahasabha Bhawan situated at Mandir Marg, New Delhi, which is held and to be held as Trust by the Working Committee during its tenure of Office for and on behalf of the Akhil Bharat Hindu Mahasabha.
    3.    Appoint workers, fix their salaries or honorarium and their duties
    4.    Prescribe rules regarding powers and duties of all Office bearers.
    5.    Pass the annual budget.
    6.    Direct, control and supervise the working of all the organization subordinate to it and affiliate or disaffiliate or suspend or dissolve them, as it may deem necessary.
    7.    Appoint ad-hoc Committees in Pradeshas after superseding the existing organization, where they are not functioning efficiently or in Pradeshas where the organization is not existing at all.
    8.    Fill up vacancies amongst its members and office bearers failing vacant owing to (i) resignation, (ii) death (iii) not attending three Working Committee meetings without information or being involved in indisciplinary activities, provided that a notice under registered cover is sent to the member concerned, prior to declaration of his place as vacant.
    9.    Settle disputes about Pradesh Hindu Sabha and hear and decide appeals against decisions of Pradesh Hindu Mahasabhas.
    10.    Take disciplinary action against members of the Akhil Bharat Hindu Mahasabha after inquiry and affording opportunity of explanation to the person or persons concerned.
    11.    Make necessary changes in the time schedule of the Biennial  Session (which shall not exceed twelve months) and of all elections and fixation of last date of enrolment of primary membership.  
    12.    Frame rules in respect of all matters not covered by the Constitution provided they are not inconsistent with it.
    13.    Generally carry on policy, administration and programme of the Akhil Bharat Hindu Mahasabha.
    ii.      When the National Working Committee is not in session, the National President shall exercise all its powers
    14. RULES OF PROCEDURE
    1.    The President the Working President if any, or in the absence of both, any of the vice-presidents present, shall preside the meeting of the All India committee or the National  Working Committee. In their absence, the members shall elect a Chairman for the meeting from amongst themselves.
    2.     The quorum for the All India Committee of the Akhil Bharat Hindu Mahasabha shall be ten, representing three Pradeshas, besides the members of the Working Committee present at the meeting.
    3.    The quorum for a meeting of the Working Committee shall be seven of whom three shall be other than Office-bearers; present at the meeting.
    4.    If any of the meetings are not held for want to quorum, a fresh notice with the same agenda should be issued to members for a fresh meeting at which quorum will not be necessary.
    5.    No quorum shall be necessary for adjourned meetings of the All India Committee and the Working Committee.
    6.    The All India Committee of the Akhil Bharat Hindu Mahasabha shall meet at least twice in a tems and every time upon requisition by not less than 30 members representing at least 5 Pradeshas.The Working Committee shall meet as often as may be necessary.
    7.    Besides the meeting of the All India Committee which generally takes place at the time of the session for the election of the office bearers another meeting of the All India Committee would be convened by the Working Committee to deal with political situation in the country and policies of the Akhil Bharat Hindu Mahasabha.
    8.    Notice of the ordinary general meetings, except the first meeting of  the All India Committee shall be given fifteen days before the date fixed Notice of ordinary general meeting of the Working Committee shall be given ten days before the date fixed.
    9.    Notices of the meetings shall be issued under instruction of the President and shall specify the place, date and time of the meeting, and also the agenda of the items fixed for consideration.
    10.    Emergent meetings of the All India Committee and the Working Committee of the Akhil Bharat Hindu Mahasabha may be convened under the direction of the President  with notices of the seven and three clear days respectively.
    11.    Copies of the resolution passed by the All India Committee of the Akhil Bharat Hindu Mahasabha and by the Working Committee shall be supplied to the members of the respective Committee within a reasonable time from the central Office at New Delhi.
    12.    All decisions of the All India Committee shall be by a majority of the members present except in the case of the amendment of the Constitution when the decision shall be by a majority of 25 or two-third of the members present, whichever is less. The decision of the Working Committee shall sbe by the majority of the members present, except in the case of decisions with regard to disciplinary action, when the majority shall be three-fourth of the members present.
     
    15. ACCOUNTS OF THE AKHIL BHARAT HINDU MAHASABHA
    The accounts of the Akhil Bharat Hindu Mahasabha shall be audited annually
    16. AKHIL BHARAT HINDU MAHASABHA SESSIONS
    1.    The Biennial Sessions of The Akhil Bharat Hindu Mahasabha shall ordinarily be held by the end of March, at such place as may have been decided upon at its previous Sessions or, in the absence of any such decision, by the Working Committee of the Akhil Bharat Hindu Mahasabha.
    2.    A Special Session may be summoned whenever necessary by the Working Committee of the sAkhil Bharat Hindu Mahasabha.
    17. RECEPTION OF COMMITTEE
    1.    The Pradesh Hindu Sabha of the Pradesh, where the Working Committee decides to hold the Session shall form the Reception Committee for that session
    2.    The Reception Committee shall be formed by the Pradesh Hindu Sabha of the Pradesh, where the session is to be held, at least four months before the Biennial Session and may include persons who are not even members of Hindu Mahasabha organization. The members of the Reception Committee shall pay not less than Rupees one hundred each.
    3.    The Reception Committee shall elect its Chairman and other Office-bearers from its own members, provided no one shall be elected Chairman or General Secretary unless he is a member of the Akhil Bharat Hindu Mahasabha.
    18.FUNCTIONS OF THE RECEPTION COMMITTEE
    1.    The function of Reception Committee shall be to make arrangement for the holding of the Session, to collect funds for the purpose, to elect the President of the Session in the manner set forth in Article 21 hereunder, to make all necessary arrangements for the successful holding of the session and reception and accommodation of  delegates, guests and visitors, as far as practicable.
    2.    The Reception Committee shall within three months of the holding of a session, submit a report of the proceedings of the session as well as a statement of receipts and expenditure to the Karyakarini Samiti of the Akhil Bharat Hindu Mahasabha.Half of the balance left over shall go to the Kendriya Mahassamiti of the Akhil Bharat Hindu Mahasabha and the other half to the Pradesh Hindu Sabha of the Pradesh where the Session was held.
     
    19. PROCEDURE FOR ELECTION OF NATIONAL PRESIDENT  
    a.  The Reception Committee shall ordinarily invite the various Pradesh Hindu Mahasabha 90     days before the date of session to send it within a fortnight not more than three names of persons, who are, in their opinion, eligible for election to the President ship of the session.
    The Reception Committee shall send a full list of names as suggested to all the persons named therein by Registered Post. Persons willing to withdraw and  / or agreeing  to contest shall inform the Reception Committee of their decision 60 days before the date of the session. The last date for the recipt of their replies would be communicated to them by the Reception Committee. Person who do not confirm their consent to consent shall be deemed to have withdrawn.
    The Reception Committee shall 60 days before the date of the session submit to all Pradesh Hindu Mahasabhas the list of namesof persons so contesting. Each Pradesh unit shall make final recommendation of any one of the names 40 days before the date of the Session. The Reception Committee shall be the meeting 40 days before the date of the session to consider such recommendations. The persons recommended by a majority of |Pradeshas and by the Reception Committee, which shall have one vote, be declared President elect of the next session.
     In case of the equality of votes, the Reception Committee shall have a casting vote. But in case an emergency arises by resignation, death or otherwise of the President thus elected or in the event of any dispute regarding the validity of election of the President-elect, the matter shall at once be referred to the Working Committee of the Akhil Bharat Hindu Mahasabha, whose decision shall be final. The President shall only be entitled to convene such a Working Committee meeting, if in his judgment   a prima facie case of irregularity and defect in election exists.
    Provided also that in no case shall a person be elected as President, who belongs to the Pradesh in which the Akhil Bharat Hindu Mahasabha session is to be held.
        
     b. The President of a Special Session shall be elected by the Working Committee of the Akhil Bharat Hindu Mahasabha.
     
    20. ELECTION OF DELEGATES
    1.    Every Pradesh shall be entitled to send delegates from amongst their members in proportion of 1 to every 50 primary members enrolled during the tenure. Every District Hindu Mahasabha should be represented in the delegated.
    2.    Members of the All India Committee of the Akhil Bharat Hindu Mahasabha shall be ex-officio delegates and shall pay Re.10 each as Delegate Fee.
    3.    Each Pradesh Hindu Sabha shall frame rules for the election of delegates of the Akhil Bharat Hindu Mahasabha within its jurisdiction and shall send to the Reception Committee of Akhil Bharat Hindu Mahasabha an alphabetical list of the delegates so elected, containing full name, occupation, age, sex, and address of each of them to reach the said Committee at least seven days before the date fixed for the holding of the session.
    4.    The rules regarding the election of the delegates for the Biennialss Session shall apply to the election of the delegates for a Special Session also.
    5.    The President may permit inclusion of a list of delegates from any Pradesh for sufficient reason, in case the list has not been submitted within time.
    6.    Any person enlisted as a member of the Akhil Bharat Hindu Mahasabha under rule 5 here above is eligible to be elected as a delegate to the Biennial Sessions.
    21.DELEGATION CERTIFICATE
    Each delegate shall, on production of a certificate of election signed or counter-signed by the Pradesh Hindu Mahasabha and on payment of a fee of Rupee 25/- receive a pass entitling him admission into the Biennial Session of the Hindu Mahasabha. This rule will apply also to a Special Session.
    22.SUBJECTS COMMITTEE
    1.    The All India Committee of the Akhil Bharat Hindu Mahasabha together with one 1/20th of the members of the Reception Committees elected by it provided their number in no case exceeds twenty, shall constitute the Subjects Committee for the Session .The President shall have the right to nominate not more than ten additional members to the Subjects Committee.
    2.    The President-elect of the Biennial or Special Session immediately after his election is declared, shall nominate a Steering Committee, with one of the Secretaries of the Akhil Bharat Hindu Mahasabha as its Convener, to prepare drafts of resolutions to be placed before the Subjects Committee.
    3.    The President shall call a meeting of the Subject Committee after the opening of the Session, which will meet as often as necessary. The General Secretary shall submit to the Subjects Committeea report of the work done during the preceding tenure. Members of the subjects committee who are not members of the Akhil Bharat Hindu Mahasabha shall not participate in discussion on this report.
     
    23.VOTING
    1.    Delegates alone shall be entitled to vote at the Akhil Bharat Hindu Mahasabha Session or otherwise take part in the deliberations.
    2.    Only the delegates of those Pradesh Hindu Mahasabhas, who have duly paid the affiliation fee to the Akhil Bharat Hindu Mahasabha, shall be entitled to participate in the deliberations of the Session.
    3.    Members of the All India Committee and delegates representing any Pradesh Hindu Mahasabha may be debarred from taking part in the proceedings of the All India Committee and of the Hindu Mahasabha of that term ( tenure) until  the quota money due from that Sabha has been paid before the Session.
    4.    All resolution placed before the delegates shall be carried by a majority of the delegates present.
     
    24.      MISCELLANEOUS
    1.    Akhil Bharat Hindu Mahasabha means All India Hindu Mahasabha,  Akhil Bharatiya Hindu Mahasabha ,Akhil Bharat Hindu Mahasabha, All India Hindu Sabha or Hindu Mahasabha  names by which this organization was known before from time to time and shall have the same authority, powers and ownership over the organization and assets, as All India Hindu Mahasabha or All India Hindu Sabha or Hindu Mahasabha etc. had.
    2.     All questions or disputes arising under the Constitutions or procedure laid down therein, amongst members and units of the Hindu Mahasabha, shall be determined by the immediate higher authority or unit. Appeals may be preferred against such decisions including those of disciplinary action by the aggrieved party or unit upto the highest authority of the Hindu Mahasabha; but the decision of any authority shall not be liable to question by any of them in a court of law and shall be final and binding on all members and units unless stayed by a higher authority of Hindu Mahasabha on an appeal.
          
               All Cases in respect of moveable or immoveable property of Akhil Bharat Hindu Mahasabha oraganist it shall be subject to jurisdiction of Delhi Courts only.   
    c. A Person shall be enrolled as a member in his permanent place of residence or  
        where he normally carries on his work. No member shall be a member of two  
        different units of the Hindu Mahasabha or any other political party in Bharat.

    In Re-Registration of Akhil Bharat Hindu Mahasabha under Section 29 A of the Representation of the People Act, 1951.
    For Application : Shri Dinesh Chandra Tyagi, President Akhil Bharat Hindu  Mahasabha .
    Uopn hearing Shri Dinesh Chandra Tyagi, President of the Akhil Bharat Hindu Mahasabha, on 23rd July, 1997 and after having carefully examined the documents on record and also of fact and circumstances of the case, the Election Commission is pleased to make the following
    ORDER
    Heard Shri Dinesh Chandra Tyagi, President of the Party, on 23.7.1997.
    Shri Tyagi stated that the party had amended its constitution, in accordance with the direction of the direction of the Hon’ble Delhi High Court in its order dated 23.3.1996 in CMP No. 4390 of 1993 ( Akhil Bharat Hindu Mahasabha Vs Election Commission on and others ) He Submitted that with the said amendment, the party constitution now conformed to the provisions of section 29A of the Representation of the people Act,1951 Narrating the history of the party since its formation in 1951 he also submitted that the party always stood committed to the principles of secularism, socialism and democracy and assured that would continue to adhere to those principles. He also supplemented his oral submissions by given written submissions to the above effect.
    In view of the above submission both oral and in writing, of shri Dinesh Chandra Tyagi and the clarifications and assurance given by him, and have regard to the decision dated 23.3.1996 of the Hon’ble Delhi High Court in the above mentioned writ  potition the commission has decide that the party ( Akhil Bharat Hindu Mahasabha ) which was granted provisional registration by its earlier order dated 2.4.1996, may be formally registered under Section 29A of the Representiation of the people Act, 1951.
